When the 22-year-old woman was brought into the Dubai Court of First Instance yesterday, she had her face covered and was wearing an abaya and sheila.
She could be seen reading verses from the Quran and using her beads and praying to God nervously waiting to hear her verdict.
The minute Presiding Judge Fahmi Mounir Fahmi pronounced her innocent, the 22-year-old H.T. stood up from her seat, started crying.
She could not hide her surprise and leapt in joy as she placed her palms on her face and uttered ‘Oh thank God!'
Her lawyer Jassem Al Naqby, from Excel Advocates and Legal Consultants contended in court that the accusation was baseless and unfounded. He asked the court to quash the case "because the evidence and investigations were inadequate and worthless".
"The law enforcement procedures were carried out improperly and unlawfully against my client. The police informant alerted Dubai Police's anti-narcotics department that my client consumed drugs… there was no mention of her trafficking or promoting hashish, defended Al Naqby.
Drugs Prosecution asked the court to implement the toughest punishment applicable as per Article 48 of the Federal Anti-Narcotics Law. According to that article a suspect who promotes drugs to others could face between 10 and 15 years in jail and/or a fine between Dh50,000 and Dh200,000.
According to the charges sheet, the Moroccan woman possessed 0.73 grams of hashish which she intended to promote to others. When H.T. appeared in court, she pleaded not guilty.
Court records showed that an Emirati anti-narcotics police sergeant, who was part of the sting, phoned the coiffeur and arranged with her to collect the hashish from her place.
"She asked me to drop by her place in Hor Al Anz. I wore civilian clothes. I reached the designated spot and asked her to meet me outside… then she stepped into my car. As soon as she handed me the hashish, police arrested her," claimed the sergeant. The judgment remains subject to appeal within 15 days.
